The developers' plans required the ability to oversail the client's land with cranes and scaffolding. Without the ability to oversail, the development project would have been considerably delayed or costs significantly increased. We advised on the client's ability to resist such use of their airspace, including the availability of claims for injunctions and damages. This enabled the client to negotiate a licence allowing the developers to proceed with their works, resulting in a six-figure payment to the landlord client.
