We represented our client, a substantial haulage company, at an ‘environmental’ public inquiry where residents had objected to the use of its established operating centre.

Often with environmental issue-based inquiries, the Traffic Commissioner strives to strike a balance between the legitimate rights of the business and the need to protect residents from excessive disturbance. As was the case here, following strong advice about the limitations of the Traffic Commissioner’s powers, a negotiated agreement on a suitable outcome for all was agreed in order to save the costs and risks of a full blown contested inquiry. The Traffic Commissioner also allowed the continuing use of the operating centre thus enabling the business to continue.
