Legal action for cyclist injured while not wearing a helmet


We are currently acting for a 40 year old woman knocked off her bicycle at speed. She sustained multiple bleeds to the brain and remained off work for some six months after the accident. Liability has been admitted although arguments are being raised over contributory negligence on account of our client’s failure to wear a cycle helmet.

In this case, we maintained that it was unlikely that a cycle helmet would have made any difference to the injuries sustained.
