We investigated and resolved a claim arising from poorly performed evisceration surgery (eyeball removal) under local anaesthetic. This was undertaken without considering the patient’s complicated ophthalmic medical history of repeated retinal detachments.
Regrettably, the treating surgeon ran into difficulties and could not complete the operation, which in itself was hugely traumatic for our client as he was awake and fully aware of what was happening. He endured further complications, required revision surgery and suffered post-traumatic stress disorder.
Initially liability was denied and it was necessary to litigate the claim. However, with the assistance of expert evidence and after a thorough investigation, the claim was settled in our client’s favour.
