Our client, a hotel guest, was walking through a North London hotel car park at night when she tripped over a lowered parking bollard which was camouflaged by the paving stones, causing a tear to a tendon in her right knee which required surgery.
After an initial period of investigation, a claim was submitted to the hotel on the basis of failing to ensure a clear and visible pathway and either draw attention to the bollard, or secure the area. Liability was admitted once medical evidence was obtained and a settlement was negotiated.
