Penningtons Manches Cooper’s aviation insurance team has been listed by The Lawyer in its preview of the top 20 cases for 2024.
The Russian aviation claims case, on which the team is advising, relates to multiple billion-dollar claims for the alleged loss of aircraft and engines following the invasion of Ukraine. The subsequent implementation of sanctions has meant that aircraft leased to Russia by foreign businesses have remained there, prompting airplane companies to commence claims against their insurers for the loss of the aircraft, on contingent and possessed covers terms.
It is both one of the largest scale insurance and reinsurance claims and one of the most complex pieces of litigation currently listed in the English Court, both in terms of the procedural weight of the matters, and the aggregate value of the sums claimed.
The Penningtons Manches Cooper team, led by associate director Louise High and partner Lisa Hillary, is acting on behalf of certain defendant insurers in six sets of proceedings, issued in the English court with a single trial set down for 46 days. It has instructed SJ Phillips KC, Elizabeth Lindesay, Harry Wright and James Goudkamp of 7 King’s Bench Walk.
Louise specialises in reinsurance and insurance litigation and commercial disputes, working primarily on complex, high value and multi-jurisdictional disputes. Her main area of expertise is within the aviation and aerospace industry. Lisa also has extensive experience in international commercial litigation and has recently successfully represented clients in a number of multi-jurisdictional claims before the High Court concerning maritime casualty, war, and political risk.
The aviation claims case is set to be heard in October, following an initial jurisdiction challenge matter which will take place in February.
