Profile

Sam is a senior associate in the firm’s London based construction advisory and dispute resolution team. He handles a broad range of claims arising under construction contracts, and has experience of all forms of dispute resolution. Sam has a particular focus on issues arising from professional negligence of construction consultants, such as claims with respect to defects and delay. In addition, Sam is often instructed to advise clients on issues surrounding termination of construction contracts.  

He has recently developed a strong practice in respect of building safety. Sam regularly advises developers, freeholders, leaseholders, managing agents and RMCs as regards their rights of recourse against those responsible for building safety defects, and insurance cover under NHBC and Premier Guarantee policies. In addition, Sam is instructed to advise clients in connection with issues arising from the developer pledge and the Building Safety Act 2022, which includes the preparation and/or negotiation of ‘works contracts’. 

As a skilled litigator and negotiator, Sam’s expertise, knowledge and experience has led him to achieve considerable outcomes for his clients.

Recent work highlights

  • Acting on behalf of a property investment fund in a multi-party TCC dispute over alleged design and construction defects in a block of flats in East London. The defects led to significant water damage, resulting in the demolition of the property.
  • In connection with the above matter, acting on behalf of the client on a claim brought against the building insurer through arbitration.
  • Acting on behalf of an overseas-based property investment fund in respect of fire safety defects to several student accommodation blocks in the North of England. Following the initiation of a claim, the developer has agreed to remediate the defects at no cost to the client.
  • Acting on behalf of a UK-based institutional freeholder over alleged defects to the façade of a high-rise building in Wales, defending a claim brought by the tenant of the building. Claims are also being brought against the project team responsible for the development.
